Terms of Service

Who these terms apply to
InternalThese Terms form a binding agreement between you and NextGen Interns LLC governing your use of the NextGen Interns platform (the “Service”). They apply to three types of users:
- Students / interns seeking opportunities.
- Employers posting opportunities and reviewing applicants.
- School / program administrators managing student accounts.
If you are under 18 you affirm that a parent or guardian has reviewed these Terms with you. Users under 13 are not permitted.
Account
InternalYou are responsible for the accuracy of your profile and the security of your login. Misrepresenting your age, school affiliation, or qualifications is grounds for immediate termination. Employers must use real company information and make accurate postings.
Acceptable use
Internal- No harassment, discrimination, or predatory behavior of any kind.
- No scraping the student database or bulk-downloading profiles.
- No contacting students off-platform until an application has been initiated.
- No reselling access to candidates to third-party recruiters.
Employer fees (if applicable)
Internal[IF EMPLOYERS PAY: Paid plans are billed monthly via Stripe. Prices stated in USD. Refunds for unused portions are issued on request within 30 days of billing. OTHERWISE state: "The Service is currently free to employers; this may change with 30 days notice."]
Employment relationship disclaimer
InternalNextGen is a platform, not an employer. We do not guarantee internships, job offers, compensation, or continued employment. The relationship between a student and an employer is entirely between them; we do not mediate disputes, payment, or performance.
School / program terms
InternalIf your school has entered into a separate agreement with NextGen (school partnership, campus pilot, etc.), the terms of that agreement govern the school's use of the Service and take precedence over these consumer Terms where there is a conflict.
User content and IP
SharedYou retain ownership of everything you post (resume, portfolio, job descriptions). You grant us a non-exclusive license to display it to other authorized users and to store it for matching purposes.
Disclaimers
SharedThe Services are provided "AS IS" and "AS AVAILABLE" without warranty of any kind. To the fullest extent permitted by applicable law, NextGen Interns LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation:
- implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- warranties arising out of course of dealing, usage, or trade;
- warranties that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful code;
- warranties regarding the accuracy, reliability, or completeness of any content, including AI-generated output;
- warranties regarding specific outcomes, results, or economic value derived from using the Services.
AI outputs produced through the Services are generated by statistical models and may contain errors, omissions, or fabrications. You are responsible for reviewing AI output before relying on or distributing it. No AI output should be treated as legal, financial, medical, or professional advice unless separately verified by a qualified human professional.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions the above exclusions apply to the maximum extent permitted by law.
Limitation of liability
SharedTo the maximum extent permitted by applicable law:
- In no event will NextGen Interns LLC, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation damages for lost profits, lost revenue, lost data, business interruption, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the Services.
- The aggregate liability of NextGen Interns LLC for all claims arising out of or relating to the Services will not exceed the greater of (a) the total amount you paid to NextGen Interns LLC for the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD $100).
- These limitations apply regardless of the legal theory of liability (contract, tort, strict liability, statutory, or otherwise) and even if NextGen Interns LLC has been advised of the possibility of such damages.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation may not apply to you. In those jurisdictions, liability is limited to the maximum extent permitted by law.
Indemnification
SharedYou agree to indemnify, defend, and hold harmless NextGen Interns LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your use of or interaction with the Services;
- your violation of these Terms or any applicable law or regulation;
- your violation of any third-party right, including intellectual property, privacy, or publicity rights;
- any content you submit to the Services or any distribution of AI output you obtain through the Services;
- any dispute between you and a third party that arises from your use of the Services.
NextGen Interns LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defenses.
Termination
InternalEither party may terminate at any time. NextGen may terminate accounts that violate these Terms, pose safety concerns, or are inactive for more than 12 months. Upon termination, your profile becomes invisible to employers and is deleted per the retention schedule in our Privacy Policy.
Governing law
InternalThese Terms are governed by [STATE] law. Disputes will be resolved in the state or federal courts located in [STATE]. You waive class-action rights.
